Introduction

The Phoenix Darts Club (referred to as ‘The Club’) facilitates the participation in and the promotion of recreational and competitive darts in the area of Waterlooville, Hampshire and to provide ordinary benefits of an amateur sports club and to do all such things as the management team thinks fit to further the interests of The Club.

The objective of this handbook is to provide members with on-going reference document setting out the conditions for membership, play in the Club and use of the venue.

The Management team reserves the right to update, amend or change these rules and other conditions so members should remain alert to notices and instructions around the venue which may replace or supersede the details given in this handbook.

To make The Phoenix Darts Club a safe and welcoming place, we ask all our members, their guests and our teams to follow our standards of behaviour. They are:

Kindness and respect

The Phoenix Darts Club celebrates diversity. We do not judge on gender, race, religion, political views, sexuality or physicality. We expect our members and guests to do the same and consider the impact individual views and beliefs may have on others.

Positive interaction

In our club, respect is fundamental. We have a collective responsibility to ensure that racist, sexist, homophobic or any form of abusive language is not tolerated.

Decent behaviour

A shared understanding of behaviour is essential to creating a safe and welcoming time at the Phoenix Darts Club. Having fun is always encouraged; being over-familiar or inappropriate is not. If you or your guests are found abusing alcohol or drugs in our club, or behaving in a way that upsets other members, action will be taken.

Club rules

Our Club rules require adherence to accepted standards of conduct to safeguard the use and enjoyment of The Phoenix Darts Clubs by our members and their guests.

1. The Club

Each member contracts with The Phoenix Darts Club, trading under Portsmouth Darts Limited. In these Club rules, we will refer to that company as ‘The Phoenix Darts Club’. 

The Phoenix Darts Club reserves the right to charge members a Club membership fee upon joining, an annual subscription fee, an administration fee for any changes to your membership, and admission to Club premise tournaments/events from time to time. The right to amend or waive any such fees or subscriptions from time to time shall be at The Phoenix Darts Club’s sole discretion.

2. The Phoenix Darts Club trademark rights

Members and their guests shall not use the names, logos, colours, trademarks, service marks, photographs, trade dress, or other identifying features of The Phoenix Darts Club and its affiliates without obtaining the specific prior written approval of The Phoenix Darts Club as to the specific use.

You hereby expressly recognise that The Phoenix Darts Club Marks are the valid, unique and exclusive property of The Phoenix Darts Club, its parent, affiliates and/or subsidiaries. Members and their guests may not produce, use or create, or authorise others to produce, use or create The Phoenix Darts Club Marks for any purpose whatsoever, including, but not limited to, in any communications, marketing, advertising or other promotional materials (including, but not limited to, brochures, flyers, invitations and email messages) that utilise The Phoenix Darts Club Marks without The Phoenix Darts Club’s prior written consent. 

MEMBERSHIP

1. Your membership application

By completing and submitting your application for membership through The Phoenix Darts Club website OR through application in person at The Club, you agree to be bound by these Club rules.

The Management Team makes the final decision on who shall become a member of The Phoenix Darts Club.

The number of members may be limited at the discretion of The Management Team to 200due to available facilities.

You are free to withdraw your application at any time. Should you wish to do so, please contact our membership team at venue@phoenixdarts.club. If your membership application is accepted, we will confirm this by sending you a ‘Welcome to the Club’ email. Your membership will commence on the date your ‘Welcome to the Club’ email is sent.

Any false declarations made when applying for membership will render such applications null and void. The person found to be making such declarations may find any future applications denied.

2. Proposing new members

Members are welcome to propose new applicants to join the Club. Application forms are available at phoenixdarts.club or at The Club.

3. Membership renewal

Membership is for a maximum period of one year running until 31st December and renewable thereafter on an annual basis.

Membership renewals are not automatic and are reviewed by our Membership Behaviour Committee on an annual basis. Their decision is final and without appeal.

4. Membership database

It is important for us to have your current details, plus a photograph of you in our membership database. By becoming a member of The Phoenix Darts Club, you agree that we can hold your personal details and a photograph to use in connection with your membership. If your contact details change, please let us know via venue@phoenixdarts.club.

5. Membership payment

The Club requires, as a condition of membership, annual subscription fees to be paid by Members of the Club.

The Management Team shall ensure that the subscription fees are set on a non-discriminatory basis and do not preclude open membership of the club.

It is within our discretion to amend our membership fees at any time, and we will notify you in advance if there are to be any changes to the amount, date or frequency of the payment of your membership fees. 

Failure to pay the annual subscription (or any instalment) within one month of the due date will result in the member not being admitted to the Club and the membership being terminated.

 6. Resignation of your membership

Membership of the Club shall terminate if:

  • the Member dies.
  • the Member, being an individual, is convicted of a criminal offence which involves dishonesty or any other offence, relating to safeguarding, drugs and any crime involving violence (including any convictions relating to children).
  • the Member resigns by notice in writing to the Club by giving at least seven days’ notice in writing to the Club.
  • the Member is in arrears to the Club and his or her subscriptions or any other payments are at least one month overdue unless otherwise agreed by The Management Team.
  • the Member holds Portsmouth Darts Academy membership only and leaves the Portsmouth Darts Academy.
  • the Member is removed from membership by a resolution of The Management Team as a result of application of the Club’s disciplinary policy.
    • The Management Team may exclude the Member from the Club’s premises until the meeting has considered this matter (save that the Member shall be entitled to attend the meeting in question for the purpose of making representations to the meeting). 
    • A person may appeal against a decision to remove him or her from membership in accordance with the Disciplinary Procedure.

In the event of a Member’s resignation or expulsion, his or her name shall be removed from the Club’s membership database.

If a Member either resigns from the Club or their membership is otherwise terminated, the Member should promptly return to the Club anything owned by the Club in their possession including any annually awarded trophies. 

If you choose to resign your membership (or your membership is cancelled part way through the year), there is no automatic right to a refund of any remaining sum equivalent to the time of membership that would be remaining had you not resigned. Refunds will be at the discretion of The Phoenix Darts Club.

7. Membership cards

Your physical membership card/membership app must be scanned at reception to gain entry to The Phoenix Darts Club. Members should also expect to be asked to present their membership card when they sit down to eat or drink. Where any member allows their card to be used by a non-member, such non-member shall be denied access to or removed from the Club, and the member whose card was used may face suspension or termination of their own membership. Please notify us immediately if your membership card is lost or stolen.

8. Rights and privileges of membership

A member shall be entitled to all the rights and privileges of the Club granted to a person in their capacity as a member and shall be bound by these rules but shall have no proprietary rights in any of the premises or in respect of property of the Club.

MEMBERSHIP TYPES

1. Adult Standard Membership

 All male and female members over 18 years of age who pay a full annual subscription. They are entitled to use the venue at any time, other than when play is restricted or the venue is closed.

2. Junior Membership – for U18’s only.

All male and female members under the age of 18, whose legal Parent/Guardian has agreed membership application and who have paid a full annual subscription. They are entitled to use the venue during opening hours only when accompanied by a parent/guardian at all times, other than when play is restricted, the venue is closed, or they are aged 10 or under after 21:00. Junior members are not permitted to bring guests with them.

3. Portsmouth Darts Academy Membership – for U18’s only.

All male and female members under the age of 18 who are an active member of Portsmouth Darts Academy are automatically granted membership to The Phoenix Darts Club during the following times: Monday 17:00-19:45pm and Thursday 17:00-19:45pm. This membership automatically grants access to 2 accompanying parents/guardians during academy sessions who therefore do not need their own Club membership. If a Portsmouth Darts Academy member wishes to use the Club outside of the times listed, they will need to apply for Junior Membership. If a member leaves Portsmouth Darts Academy, their Phoenix Darts membership is automatically revoked unless they have the appropriate Junior Club membership already in place, or they make a successful application for Junior Club membership. Portsmouth Darts Academy members are only permitted to bring guests during the permitted times of membership use and will need to confirm guest attendance with Portsmouth Darts Academy directly.

USING THE CLUB

1. Guests

Adults Members are permitted to bring up to three guests with them to The Club at any one time, although please be aware that during very busy times we may have to restrict member/guest access. A member’s guests may not enter the Club without that member being present. Members may not be separated from their guests within the Club or allow their guests to remain in the Club when they leave. Members are responsible for ensuring that their guests follow all Club rules and policies, even when the member is not in the company of their guests, and a member may face suspension or termination of their membership if their guests violate such rules or policies. Junior members are not permitted to bring guests with them.

A member bringing guests must ensure that the guest’s name(s) is entered in the relevant guest book. This is a requirement of Licensing Laws and is to be strictly observed.

Guests may only be permitted to visit on 4 separate occasions before they are required to apply for the applicable Club membership.

Any guest that has previously been asked to leave the premises for whatever reason may not be invited back, and future visits will be refused.

2. Children

The Club is designed for adults but aims to be child-friendly. Please be considerate of other members when you bring children, who count as part of your guest allowance. Please remember that your children are your responsibility at all times when present in the Club, and ensure they are not left unattended at any time.

Under 10’s are not permitted in the Club after 21:00 unless included as part of a private event guest list.

3. Animals

No animals are allowed in the Club, except for legally recognised service animals.

4. Bills 

All bills must be settled in full before leaving the Club; there is no option for members to pay at a later date. Members are also responsible for their guests’ bills. If a member’s bill or their guests’ bill is not paid, the member may face suspension of their membership.

5. Club environment

Our Club is designed to be a casual, relaxed space. Members and their guests should be mindful of the events they host and how they dress in order to maintain this environment. It is first and foremost a Darts Club and appropriate attire should be worn e.g. no open toed shoes of any form.

Any member, guest or visitor not suitably dresses will be asked to leave the Club.

6. Food and drinks

Any external food or drink, aside from water, is not allowed to be brought into or consumed in the Club. This includes items such as packed lunches, snacks or alcoholic drinks. The only exception to this is if there is a valid medical reason. 

7. Smoking 

No smoking or vaping of any kind is allowed inside the Club at any time. The Phoenix Darts Club reserves the right to prohibit or limit smoking in any external area of the Club premises at any time at its sole and absolute discretion.

The Phoenix Darts Club reserves the right to designate certain outside areas of the Club premises as smoking areas and to change the location of such areas at any time. However, all members and their guests are requested to respect the wishes of other members and their guests with respect to smoking, and to refrain from smoking when requested to do so.

8. Private hire and Club maintenance 

The Phoenix Darts Club may at times, with or without notice, close all or part of a Club to members and their guests for private events or for necessary maintenance, repair or redecoration work. We will seek to ensure that any such area, facility or service is reinstated as soon as practicable. The Phoenix Darts Club reserves the right to compensate members for any closures through any method that they see fit.  

9. Use of equipment and facilities

Use of any equipment, areas or facilities available at the Club is entirely at the risk of a member or guest. You must not use any equipment, or undertake any activity at a Club, unless you are satisfied that you are competent to do so in a safe and proper manner.

When using any equipment and facilities available at the Club, you must take care to safeguard your own health and safety, and that of other people. You will be solely responsible for any loss or injury that you cause to yourself, other persons, or to the equipment or facilities through your unsafe or improper use of the equipment or facilities. This includes your use of them while under the influence of alcohol or medication, or your failure to advise staff of a medical condition relevant to your use of the equipment or facilities.

10. Entering and leaving the Clubs

All members and their guests are asked to respect our nearby residents by being quiet when entering or leaving the Club premises, or while in the surrounding area.

11. Constitution

The Club is constituted to encourage non-political, social and recreational activities.

12. Opening Hours

The Club is operated under the requirements of its Premises Licence, as granted by the local licensing authority.

The Club has strict opening hours and hours in which the provision of Alcohol for sale is allowed.

The sale of liquor shall be restricted to persons aged 18 or over who are:

  • Adult members of the Club or
  • Guests of members or
  • Persons attending the Club for any social or other function authorised by the Management team. An annual record of every function shall be maintained by the Management Team.

The Club operates a ‘Challenge 25’ policy whereby anyone on the premises who appears to be under the age of 25 will be asked for a valid ID when attempting to purchase alcohol.

The Club must be vacated within 30 minutes of the bar closing. Last orders will be announced 15 minutes prior to the bar closing and ‘drinking-up’ time is a legal requisite of The Club premises licence.

No member or guest is permitted to leave the premises with alcohol purchased onsite, and if found to do so, may have their membership terminated.

13. Lost Property

Items found on The Club premises or handed in as ‘ lost property’ will be retained for a period of 60 days before The Club shall dispose of said items as appropriate. To recover lost property, a member will need to provide a description of the item to a member of The Club staff who will check what has been found.

14. Filming and Photography

We request that members do not film or take photos whilst inside the Club unless specific consent is granted by the Management Team. Please respect other members right to privacy whilst using the Club facilities, and if asked to halt filming or photography please do so immediately.

Occasionally, the Management Team will request the option to record or photograph aspects of the Club in use, however disclaimers will be placed in plain view announcing recording is taking place, and this will be used purely for advertising purposes.

BEHAVIOUR

1. Drugs, substances and items

No member or guest shall purchase, use, ingest, possess, sell or otherwise distribute illegal drugs or other substances, or attempt to do any of the same with any member or guest. No member or guest shall ask any The Phoenix Darts Club staff for illegal drugs or other substances while on Club premises, or in the immediate vicinity thereof. No member or guest shall occupy a closed bathroom stall with anyone else. If any of the actions above prove true, the relevant member and/or guest will be removed from the Club and the membership in question will be terminated.

No member or guest shall purchase, sell, use or possess any object that is illegal or offensive while on Club premises or in the immediate vicinity thereof. If any such objects are found, the item will be confiscated, the relevant member and/or guest will be removed from the Club, the membership in question will be terminated and, depending on the circumstances, we may have to call the police or relevant authorities. 

2. Disclosing member and guest identity

The Club operates a strict non-disclosure policy of sharing details of any other member, guest, private hire or member event in the public domain. This includes press and all social media platforms including Facebook, X, Instagram, TikTok and personal blogs. Members will be held accountable if they or their guests are found breaking this policy. 

3. Disciplinary procedure

Conduct by a member or guest that is prejudicial to the reputation and character of The Phoenix Darts Club may result in suspension or expulsion of such member or guest. Such conduct may include inappropriate, violent or abusive behaviour, or the communication of information concerning the Club affairs, members or their guests in the Club to the media. An expelled member may not return to any Club as a guest. A refund of the expelled member’s subscription will be at the discretion of The Phoenix Darts Club. Any member or members who wilfully remove, damage or destroy any property belonging to the Club, or to members or guests on the premises of the Club, will be liable to expulsion and/or suspension or termination of their membership.

Every member binds themselves to abide by the rules, bylaws and regulations of The Phoenix Darts Club at all times upon acceptance as a member. If The Phoenix Darts Club considers that any member’s (or their guests) conduct either inside or outside of the Club premises is, at its absolute discretion, contrary to the interests of The Phoenix Darts Club, The Phoenix Darts Club may with immediate effect expel the member or guest from the Club premises, and/or suspend or terminate that member’s membership without having to give any reason to such member or guest.

If a member is placed on suspension for any reason, The Phoenix Darts Club reserves the right, in its absolute discretion, to charge and collect such member’s membership dues and fees during such period of suspension, should they so arise. 

4. Membership Behaviour Committee

Membership review

Members who don’t follow these values and standards of behaviour risk their membership being reviewed by the Membership Behaviour Committee. This could result in your membership being suspended or revoked. Members are also responsible for ensuring that their guests follow these same rules, and if these are violated the same repercussions will apply to the member.

The process for this is as follows:

  1. An incident involving a member or their guest(s) either happens at The Phoenix Darts Club premises, an offsite event, or in circumstances that may affect our members.
  • The membership team reviews the incident and sources witness statements.
  • The membership of the member(s) involved is paused while this investigation is happening.
  • Once all the facts have been reviewed, the Membership Behaviour Committee decides on a final decision.
  • This decision is communicated to the member(s) and they are either given a caution, or their membership is suspended or terminated.

In the event of any dispute arising as to the meaning or interpretation of these rules, the matter shall be referred to the Membership Behaviour Committee who will decide on the status of a member’s future use of the Club. This decision is final and without appeal. These rules shall be governed and construed in accordance with English law and each member agrees to submit to the exclusive jurisdiction of the courts of England.

5. Amendments to the Club rules

From time to time, The Phoenix Darts Club may, in its sole and absolute discretion, amend our Club rules in the best interest of our members, guests and/or employees. Please be aware that such amended Club rules shall apply to you at all times.

PRIVACY AND DATA 

1. Your personal information

We will use the personal information you provide us in connection with your membership in accordance with our Privacy Policy.

2. Confidentiality

The Phoenix Darts Club management and all staff members are required to adhere to the strictest confidentiality standards, and pledge to maintain all records and personal information concerning the members and their guests in the strictest confidence.

3. Club events

While you are a member or a guest at our Club, we may ask you to give your views of, and experiences at, The Phoenix Darts Club. We may also film, video or photograph our member events and activities at our Club for use in our membership programmes, as well as advertising, promotions, public relations, and other commercial/business purposes. If you take part in these interviews or events, you agree to us using your name, image and limited other information. You also consent to us publishing any materials produced by, or for, us for any purpose without your further consent, and you waive your right to receive any payment from us in connection with such publication. When we host events in the Clubs that we are recording, we will endeavour to display signs to make this clear to members and guests.

SAFETY AND SECURITY

1. Accidents and injuries

We want all our members and guests to relax and enjoy the activities and facilities available at our Club safely. Members and their guests agree to observe the Club rules and any signs published or displayed at our Club at any time.

If a member or guest has an accident or suffers any injury at, or in the vicinity of, the Club, please report this as soon as possible to a member of staff and, in any event, within 24 hours of the incident. As well as making our members’ and guests’ wellbeing a priority, this information is needed in order to help us comply with our health and safety obligations and for insurance purposes.

2. Liability of The Phoenix Darts Club

All items brought into and/or left in the Clubs are entirely at the risk of the member or their guests. The Phoenix Darts Club, its servants and/or agents shall not be liable to any member or guest for any loss, damage or injury suffered by them or their property howsoever caused, save in respect of death or personal injury to a member or guest to the extent caused by the gross negligence of The Phoenix Darts Club, its servants and/or agents. This is not intended to affect any mandatory rights a member or guest may have under local law that we cannot legally restrict or exclude.

3. CCTV

Members and their guests should be aware that for safety reasons, we use CCTV across all of our Clubs. We do not provide CCTV footage, except pursuant to a police request as part of an active investigation, or as required by subpoena or law.
